          Samuel Bailey & Associates has initiated plans to assist foreign investors desirous of obtaining 'E' category visas as well as domestic firms interested in obtaining investment visa capital.

          There has been a period of extraordinary activity and change in the legislative and regulatory immigration arenas over the last year.  The INS and the Department of State have finalized new rules that make considerable changes to the regulations that govern the "E" nonimmigrant visa category for treaty traders and investors.   The rules reflect new administrative interpretations of the Immigration and Nationality Act, which provides authority for treaty trader and investor visa classification.   Until these new rules became final, the only guidance on the substantive elements for E visa classification was in the State department's Foreign Affairs Manual.

Latin American Practice

          The firm's practice in Latin America consists of advising domestic multinational clients on starting business in Latin America, specifically Peru, that includes structuring transactions; negotiating and drafting the necessary legal documents in English, obtaining Spanish translations, working with local counsel in the following and other related practice areas:

  • Business Investment, including the acquisition and disposition of businesses; the establishment of and investment in joint ventures and the structuring of distributorship, licensing, and agency arrangements;

  • negotiation of commercial contracts; and compliance with foreign investment laws.
